IMThing Terms of Service
These Terms of Service govern your use of the IMThing mobile applications, websites, and related IoT GPS tracking, device-management, alert, and connectivity services (collectively, the “Services”). By creating an account, signing in, or using the Services, you agree to these Terms.
1. Eligibility and Account
- You must provide accurate account information and keep your sign-in method secure.
- You are responsible for activity performed through your account and for devices you bind, share, or manage.
- Do not create accounts or use identifiers in a way that impersonates another person, evades restrictions, or violates applicable law.
2. Third-Party Sign-In
You may choose to sign in through supported third-party providers such as Apple or Google. Those providers’ terms and privacy policies also apply to their services. IMThing verifies the provider credential and associates it with an IMThing account; we do not receive your provider password.
3. Devices and Location Services
- The Services may display device location, route history, status, geofence, and alert data. You must have lawful authority and, where required, appropriate notice and consent before tracking a person, vehicle, pet, or other asset.
- Device availability, network coverage, positioning accuracy, map data, and alert delivery can be affected by hardware, battery, carrier networks, operating systems, and third-party services. They are not guaranteed for safety-critical use.
- Do not use the Services as the sole basis for emergency response, navigation, medical, security, or life-safety decisions.
4. Acceptable Use
You may not misuse the Services, interfere with their security or operation, attempt unauthorized access, reverse engineer except where law permits, transmit unlawful content, conduct fraud, or use the Services to violate privacy, employment, transportation, export-control, or other applicable laws.
5. Fees and Renewals
Some device connectivity or service plans may require payment. Plan terms, prices, taxes, renewal conditions, cancellation options, and any refund policy shown at purchase form part of the applicable order. Payments are for physical-device connectivity and related services, not standalone digital content.
6. Intellectual Property
IMThing and its licensors retain all rights in the Services, software, content, trademarks, and documentation. Subject to these Terms, we grant you a limited, personal, non-transferable right to use the Services for their intended purpose.
7. Privacy and Data
Our handling of personal data is described in the IMThing Privacy Policy. You retain responsibility for data you submit and for ensuring that your use of device and location data is lawful.
8. Suspension and Termination
We may limit or suspend access where reasonably necessary to protect users, the Services, or comply with law, including for fraud, abuse, security incidents, or material violations of these Terms. You may request account deletion in the app through Profile > Delete Account; some data may be retained where required for legal, security, accounting, or dispute-resolution purposes.
9. Disclaimers and Liability
To the extent permitted by law, the Services are provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation, exact location results, or compatibility with every device or network. Nothing in these Terms excludes liability that cannot legally be excluded.
10. Changes to These Terms
We may update these Terms to reflect changes to the Services, law, or operations. Material changes will be posted here and, where appropriate, communicated through the app or another reasonable channel. Continued use after an effective update means you accept the updated Terms.
